E. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in this Warranty Policy is intended to exclude, restrict or modify any right or remedy available to a consumer under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
The Cloveragri warranty is provided in addition to any rights and remedies available under the Australian Consumer Law.
F. Representations and Warranty Authority
This written warranty sets out Cloveragri's standard manufacturer's warranty.
No dealer, distributor, employee or other third party is authorised to alter or extend this warranty unless the variation is confirmed in writing by Cloveragri Machinery Australia Pty Ltd.
Nothing in this section limits any rights or representations that cannot lawfully be excluded under the Australian Consumer Law.
G. Purchaser Responsibilities & Warranty Claims
To assist Cloveragri in assessing a warranty claim, the purchaser should:
-
Promptly report the fault to info@cloveragri.com.au.
-
Provide the purchaser's name, equipment model and serial number where applicable.
-
Provide a clear description of the fault.
-
Supply photographs and/or video showing the issue where reasonably requested.
-
Maintain the equipment in accordance with the supplied operator and maintenance instructions.
-
Retain reasonable records of servicing and maintenance.
-
Stop operating the equipment where continued use could cause additional damage or create a safety risk.
Where a fault occurs, continued operation after the problem becomes apparent may cause further damage that is unrelated to the original fault and may therefore not be covered.
Cloveragri may request additional photographs, video, service records, diagnostic information or inspection of the equipment before determining the appropriate warranty response.
Returns & Exchanges Policy
At Cloveragri Machinery Australia, we want customers to select equipment that is suitable for their intended application.
Please check product specifications, tractor requirements, PTO requirements, hydraulic requirements, dimensions and attachment compatibility before purchasing.
Change-of-Mind Returns
Cloveragri may, at its discretion, accept the return of a new and unused product where:
-
The customer contacts Cloveragri at info@cloveragri.com.au and obtains return authorisation before returning the product.
-
The return request is made within 30 days of delivery.
-
The product has not been used, installed, assembled or modified.
-
The product is returned in its original condition and packaging.
-
All manuals, accessories, components and supplied items are included.
-
The product is capable of being resold as new.
-
The product passes inspection by Cloveragri upon return.
Unless otherwise required by the Australian Consumer Law:
-
Return freight is the responsibility of the purchaser.
-
Original delivery and freight charges are non-refundable.
Cloveragri reserves the right to refuse a change-of-mind return where these conditions have not been met.
Exchanges
Where a customer wishes to exchange a new and unused product for another Cloveragri product, the request will generally be assessed under the same conditions as a change-of-mind return.
Any difference in product price and applicable freight charges will be payable by the customer before the replacement product is dispatched.
Products that have been used, installed, assembled or modified cannot generally be exchanged for change-of-mind reasons.
This does not affect the customer's rights under the Australian Consumer Law where a product is faulty or otherwise fails to meet a consumer guarantee.
Incorrectly Ordered or Unsuitable Products
Customers are responsible for confirming that equipment is suitable for their tractor, machine and intended application before purchase.
Ordering the incorrect size, model or specification, or determining after purchase that a product is unsuitable for the customer's intended application, will generally be treated as a change-of-mind return rather than a product fault.
Provided the product remains new, unused, unassembled and in its original packaging, Cloveragri may approve a return or exchange in accordance with this policy.
Non-Returnable Items
Unless required under the Australian Consumer Law, Cloveragri does not accept change-of-mind returns for:
-
Products that have been used, installed, assembled or modified.
-
Special-order or custom-built products.
-
Products damaged through misuse, incorrect installation, incorrect setup or improper operation.
-
Products returned without prior authorisation.
-
Clearance or discontinued products.
-
Parts or products that cannot reasonably be resold as new.
Faulty Products
If you believe a product is faulty, please contact Cloveragri before returning it.
We may request photographs, video or other information to help identify the problem and determine the appropriate remedy.
Where a product fails to meet a consumer guarantee under the Australian Consumer Law, the appropriate remedy will be provided in accordance with the law.
Faulty products are not treated as change-of-mind returns.
Damaged in Transit
Please inspect your equipment as soon as practicable following delivery.
Any visible freight damage, missing components or packaging damage should be reported to Cloveragri within 48 hours of delivery where possible.
Please:
-
Retain the packaging.
-
Photograph the packaging before removing it where possible.
-
Photograph any damage to the equipment.
-
Contact Cloveragri promptly at info@cloveragri.com.au.
Reporting freight damage promptly assists Cloveragri in making a claim with the freight provider.
Nothing in this requirement limits rights that cannot be excluded under the Australian Consumer Law.
